1. Agreement

By accessing AgroJobs.ca (the “Website,” the "Company"), you agree that you have read, understood, and agree to be bound by these terms and conditions (the “Terms”).

2. Age

You may only access the Website if you are over the age of majority in the province in which you reside or you are under the age of majority and your parent or guardian agrees to be bound by the Terms on your behalf and consents to your access to and use of the Website.

3. Changes to the Terms

AgroJobs.ca reserves the right to revise the Terms at any time without notice. By accessing the Website, you agree to be bound by the current version of the Terms.

4. Authority

If you are using the Website on behalf of any entity, you represent and warrant that you are authorized to accept the Terms on such entity’s behalf, and such entity shall be bound by the Terms.

5. Acceptable Use

Candidates / Job Seekers

The purpose of the Website is to connect candidates (“Job Seekers”) with employers (“Employers”).

You agree that the information in your candidate profile is accurate and not exaggerated, incorrect, or untruthful. You also agree not to include anything personal in your bio, such as your social insurance number, license number, birth certificate, etc.

You agree and understand that employers of jobs posted "by AgroJobs.ca" (the Website) will never see your candidate profile. These job postings are created using crawling technology, similar to what Google and other search engines use. The employer's name listed in the job posting provided by AgroJobs.ca (the Website) may or may not have signed up for an employer account on AgroJobs.ca (the Website).

You agree to allow Employers who sign up and post their own jobs to view your candidate profile when you (the Job Seeker) apply for a job and select to have your candidate profile viewable by an employer through your profile settings.

The Company reserves the right to edit or remove any candidate profile that does not comply with the Terms without prior notice.

The Company reserves the right to deny, at our sole discretion, any candidate from accessing the Website or any portion thereof without prior notice.

The Company makes no warranties or representations regarding the truthfulness, accuracy, correctness, reliability, or otherwise of the information contained on this Website.

Employers

The purpose of the Website is to connect candidates (“Job Seekers”) with employers (“Employers”) in Canada.

You agree that you will not submit any job posting to this Website which is:

  • False or misleading
  • A pyramid scheme or multi-level marketing opportunity.
  • Sexual in nature or related to any of the following: escort services, prostitution, erotic dancing, or erotic massages.
  • Related to modeling or talent searches; (e) Libelous, defamatory, abusive, threatening or an invasion of privacy.
  • Obscene or pornographic.
  • In violation of any law.
  • Advocating any illegal activity.
  • Advertising or otherwise soliciting funds.
  • Selling goods or services; or (k) An infringement of any intellectual property or other right of any entity or person, including, but not limited to violating anyone’s copyrights or trademarks. (the “Prohibited Content”).

The Company reserves the right to edit any job posting for clarity or length and to modify or remove any Prohibited Content from the Website without prior notice.

The Company reserves the right to share any job posting with partner networks, social media platforms (Facebook and Instagram), in-house email list subscribers, and third-party websites such as Google Search and Google for Jobs Recruitment Network.

The Company reserves the right to deny, at our sole discretion, any employer from accessing the Website or any portion thereof without prior notice.

The Company makes no warranties or representations regarding the truthfulness, accuracy, correctness, reliability, or otherwise of the information contained on this Website.

The company uses crawling technology, similar to Google and other search engines, to find publicly available jobs and post details of those jobs on AgroJobs.ca (the Website). You agree that if you sign up as an employer and we have posted or continue to post jobs from you that are similar, we will be able to continue to list that job until the expiry date is hit. 6. Payments

When you provide payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you will notify us of changes to the payment information. We reserve the right to utilize third-party credit card updating services to obtain current expiration dates on credit cards.

AgroJobs.ca uses the third-party payment platform Stripe and the Stripe API to process credit and debit card transactions from your AgroJobs.ca account.

By using AgroJobs.ca and agreeing to the AgroJobs.ca Terms and Conditions, you also agree to be bound by Stripe's Terms of Service.

You expressly understand and agree that AgroJobs.ca shall not be liable for any payments and monetary transactions that occur through your use of the service. You expressly understand and agree that Stripe handles all payments and economic transactions. You agree that AgroJobs.ca shall not be liable for any issues regarding financial and monetary transactions between you and any other party, including Stripe.

You are responsible for all transactions (one-time, recurring, and refunds) processed through the Website and/or Stripe. AgroJobs.ca is not liable for loss or damage from errant or invalid transactions processed with your Stripe account. This includes transactions that were not processed due to a network communication error or any other reason. If you process a transaction, it is your responsibility to verify that the transaction was successfully processed.

You understand that AgroJobs.ca uses the Stripe API to process payments and that the Stripe API is subject to change at any time, and such changes may adversely affect the Website. You understand and agree to not hold AgroJobs.ca liable for any adverse effects that actions (whether intentional or unintentional) on the part of Stripe may cause to your AgroJobs.ca account or your business.

You must not process stolen credit cards or unauthorized credit cards through Stripe and/or your AgroJobs.ca account.

7. Email Subscriptions

By filling in the form with your email address, you consent to receive emails regarding updates, promotions, and relevant information about our services or products. This includes but is not limited to newsletters, updates, alerts, special offers, and announcements. We value your privacy and will use your email solely to communicate with you about our offerings. You can unsubscribe from these communications anytime by using the 'unsubscribe' link in the emails. Please note that by providing your email address, you acknowledge and agree to receive these communications from us unless and until you choose to opt-out.

8. Limitation of Liability

In no event shall the Company and its affiliates or any of their respective directors, officers, employees, agents, content providers, other representatives, successors and assigns be liable for any direct, indirect, special, incidental, consequential, punitive, or aggravated damages (including without limitation damages for loss of data, income or profit, loss of or damage to property, third party claims, disclosure of confidential information or loss of privacy) or any other damages of any kind, arising out of or in connection with: the Website, any information, forms, agreements, and documents available through the Website, any termination of access to the Website and the services; any software tips, tools, products or services offered through or advertised on the Website; any content, materials, act or practice of any third party provider; any link provided on the Website; any trojan horses, bugs, viruses and the like; deletion, corruption or failure to store any data; your failure to provide correct, accurate and up-to-date information; and your account and password or your failure to keep them secure, whether or not the Company has been advised of the possibility of such damages. This exclusion of liability shall apply to the fullest extent permitted by the law. This provision shall survive the termination of your right to use this Website.

You acknowledge and agree that you will be fully liable for all damages resulting directly or indirectly from your use of the Website.

9. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates and their respective directors, officers, employees, agents, content providers, other representatives, successors, and assigns from and against all claims, liabilities, losses, damages, suits, actions, costs and expenses (including legal fees) relating to or arising out of your use of the Website including the transmission or placement of information or material by you on the Website. This provision shall survive the termination of your right to use this Website.

10. Jurisdiction

The Terms are governed and interpreted under the laws of the Province of Ontario. Suppose any portion of these Terms is deemed unlawful, void or unenforceable. In that case, that part shall be deemed severable and will not affect the validity and enforceability of any remaining provisions.
